set for a busy year
The American Subcontractors Association
of Greater Milwaukee is pleased to be a part of this special section
of The Daily Reporter. Chartered in 1986, our Greater Milwaukee chapter
association represents more than 110 subcontractors, suppliers and service
providers in southeastern Wisconsin. We are one of more than 50 chapters
nationwide.
Reducing
retainage
Retainage is the holding back of a portion
of the amount earned by the contractor, even though the contractor has
properly completed the work. Wisconsin statutes require public owners
to hold back 10 percent of the money earned by the contractor on the
first 50 percent of the project, but don’t require retainage on the
second half if satisfactory progress is being made.

and relationships was the cornerstone of its success.

The old Marshall Field’s building at the
corner of Wisconsin and Plankinton avenues was one of Milwaukee’s premier
department stores for almost 100 years. The building lay dormant for
nearly two years before renovation work began in the fall of 1999.
Getting
the most out of our Business Practices Interchanges
We generally conduct a "Business Practices
Interchange Session" right before dinner at each regular ASA chapter
meeting. In member surveys, the BPI ranks high as a valuable member
benefit. Our membership has grown, and more and more new representatives
and guests are attending ASA meetings. Accordingly, this information
sheet is provided to help you get the most out of the BPI sessions.
Why
we need to limit hold harmless clauses
A few weeks ago, The Daily Reporter chronicled
the saga of how a prime contractor and 19 subcontractors were denied
prompt payment for services performed in the demolition of County Stadium.
After months of delay, legal wrangling and mounting debts, a settlement
was reached and payments made. Exposing this dispute to public sunlight
might have been the catalyst that led to a successful result.
Limiting
indemnification, hold harmless clauses and additional insured endorsements
Construction contracts, whether from the
owner to the general contractor or from the general contractor to the
subcontractor, contain indemnification and hold harmless clauses. These
clauses shift liability risk from one party to another. Contracts often
require contractors to add other parties as "additional insureds" to
insurance policies as a way to unfairly circumvent indemnification clauses.
Maximizing
your surety bond credit potential
If you desire to increase your overall
capacity to obtain higher levels of surety credit, you must establish
and maintain a relationship of mutual trust, confidence and respect
between yourself and your surety.
The
construction contract: A financial mine field for the unwary
No one in their right mind would knowingly
attempt to cross a mine field without first detecting and disarming
any land mines. Failure to do so could result in serious injury or death.
Changes
needed in states construction law
Wisconsin is regarded as one of the more
progressive states with respect to construction law. The state’s construction
lien law has several exemplary provisions that protect both the public
and contractors.
